The training organization ERELIA SIRET 348012428 00036, headquartered at 99 route de Versailles 91160 Champlan, organizes and delivers professional training courses. Its activity as a training provider is registered with the DIRECCTE d’EVRY under n° B 348 012 428; this registration does not imply state approval.
The Customer’s signature of these General Terms and Conditions of Sale (hereinafter referred to as “GTCS”) implies their full and unreserved acceptance. The GCS take precedence over any other document issued by the customer, and in particular over any general terms and conditions of purchase, except in the event of a framework agreement or specific commercial agreement with the customer. All other ERELIA documents, such as brochures and catalogs, are for information purposes only. The fact that ERELIA does not avail itself of any of the present conditions at a given time may not be interpreted as a waiver of the right to avail itself of them at a later date.
You can register by e-mail at ade@erelia.fr. Your registration will be taken into account on receipt of the professional training agreement or contract and these GTC duly signed and bearing a commercial stamp (if possible). For distance learning courses, it is the participant’s responsibility to ensure that his or her computer equipment is properly configured before the course within the allotted time.
Cancellations must be made in writing. Substitutions of participants are permitted at any time, free of charge, subject to notification by e-mail to ade@erelia.fr and the forwarding of the name(s) and contact details of the substitute(s) no later than the day before the course.
You have the right to cancel a registration at no charge, provided that you notify ERELIA by e-mail with acknowledgement of receipt to ade@erelia.fr, received no later than fourteen [14] calendar days before the training date.
In the event of cancellation received less than fourteen [14] calendar days before the date of the course (or of the first module in the case of a distance learning course), the full amount of the registration fee remains payable to ERELIA. Any course not attended or only partially attended is due in full.
All prices are quoted exclusive of tax. They will be increased by applicable duties and taxes.
Our prices include the training course, the educational documentation provided during the course, and any electronic files made available. If you have any questions about our pricing conditions, please contact our customer service department by e-mail at ade@erelia.fr. In the case of payment by an OPCO, your OPCO’s financing agreement must be sent to us as soon as possible. If ERELIA has not received the financing agreement, you will be invoiced for the full cost of the training. In the event of partial reimbursement by the OPCO, you will be invoiced directly for the part not reimbursed.
Any invoice not paid by the due date will automatically bear interest at the rate applied by the European Central Bank to its most recent refinancing operation, plus 10 (ten) points. In the event of non-payment of a single invoice on its due date, all sums owed by the Customer shall become immediately payable.
All invoices recovered by our legal departments will be subject to a penalty clause of 15 (fifteen)% of the amount due, which is non-reducible within the meaning of article 1229 of the French Civil Code.
The employer, or as the case may be the participant, undertakes to take out and maintain, in anticipation of and during the training course, civil liability insurance covering any direct or indirect bodily, material or immaterial damage that may be caused by his actions or those of his employees, to the detriment of ERELIA or the participants. He also undertakes to take out and maintain civil liability insurance, also designating ERELIA as the insured party for all acts detrimental to third parties that may have been caused by his employee, and containing a waiver of recourse clause, so that ERELIA cannot be sought or worried.
ERELIA reserves the right, if the number of participants in a training course is deemed insufficient from a pedagogical point of view, to cancel the course no later than fourteen [14] calendar days before the scheduled date. ERELIA reserves the right to postpone the course, modify the location or content of the program, or replace a trainer, should circumstances beyond its control require it to do so.
ERELIA reserves the right, without compensation of any kind :
In the context of respecting the intellectual property rights attached to course materials or other educational resources made available solely to training participants, the Customer may not reproduce, directly or indirectly, in whole or in part, adapt, modify, translate, represent, market or distribute said materials and educational resources to members of its staff who are not participants in ERELIA training courses or to third parties, without the express, prior and written authorization of ERELIA or its assignees.
ERELIA undertakes to ensure that the collection and processing of your personal data, carried out from the https://www.erelia.fr website, complies with the amended French Data Protection Act No. 78-17 of January 6, 1978 (known as the “Loi Informatique et Libertés”) and Regulation (EU) No. 2016/679 of April 27, 2016 known as the “General Data Protection Regulation” (or “GDPR”). This policy describes how ERELIA undertakes to collect, use and protect your personal data. JURISDICTION THIS AGREEMENT IS GOVERNED BY FRENCH LAW
In the event of a dispute concerning the interpretation or execution of any of these provisions, and in the absence of an amicable agreement between the parties, the Commercial Court having jurisdiction over the head office of the training organization shall have sole jurisdiction.
